Juvenile Delinquency Adjudication Overturned on Appeal

Description

The juvenile court determined that the juvenile was dealing Adderall at school. But the pills that were allegedly involved were never recovered. A witness only testified that they were blue pills that the juvenile allegedly referred to as Adderall. The juvenile appealed and argued that there was not enough evidence to support the adjudication. The Court of Appeals agreed and reversed the finding of delinquency.

Custodial Grandmother Wins Appeal After Being Denied Increase in Child Support

Description

A grandmother asked a judge for more child support from the father of her grandchildren. The grandmother had custody of two of her grandchildren was recently awarded custody of a third. Father earned an average weekly gross income of $1,391 before he quit his job and admitted he could earn between $1,500 and $1,800 per week. However, the judge found father’s potential income was only $500 per week because he was no longer working. The Grandmother appealed, and the Indiana Court of Appeals determined that the child support calculation was incorrect.

Wrongful Criminal Sentence Corrected on Appeal

Description

The judge sentenced the defendant to five years of community corrections. However, the State had conceded that four years was the maximum amount of time that could be served. The defendant appealed, and the Indiana Court of Appeals agreed and reduced the sentence by a full year.
